Customs

International trade has, in recent years, become a very important concept in Malta. At GMX we regularly advise clients on a number of customs related issues such as; the import and export of services as well trade solutions.

Under Maltese law, international trade is mainly regulated through the Importation Control Regulation (Legal Notice 242 of 2004), whereas the Customs Ordinance deals more specifically with the import and export of goods. Under these laws certain products require an authorization or an import license issued by the Trade Services Directorate to be imported. Likewise, there are also certain goods that require authorisations or export licenses issued by the Trade Service Directorate to be exported.

Trade Compliance

GMX’s international trade regulation practice advises clients on, and resolves issues related to, the impact of regulations mandated by the European Union and World Trade Organization. Our primary objective is to help clients overcome commercial obstacles related to market access and import and export-related difficulties that result from government intervention and market regulations worldwide

What we do in Trade Compliance

We regularly advise clients from a wide range of sectors on compliance and relevant procedures, including:

  • Export and re-export of sophisticated or other “special” products, services and technology, such as exports of certain dual-use products and services (military and non-military) to “sensitive” or otherwise targeted countries and regions.
  • International trade sanctions, (e.g. in relation to Iran and Syria).
  • Sector-specific controls (e.g. proliferation of missiles, chemical weapons or nuclear technology, and antiterrorism controls).
  • Anti-boycott regulations.
  • Anti-bribery and other similar issues, such as the accounting provisions of the OECD Convention on Combating Bribery of Foreign Public Officials in International Business Transactions and related domestic implementation measures, and the UK Bribery Act 2010.

Trade Sanctions

We regularly advise on the sanctions regimes introduced internationally against countries such as Iran, Syria, Libya, Sudan, Iraq and Ivory Coast. Our advice focuses on sanctions adopted at UN, EU, UK, UAE, French and Australian levels, and we regularly co-ordinate advice from other jurisdictions such as the United States, South Korea, Bermuda, Singapore and Switzerland.

We also advise on payment issues with respect to sanctions and appropriate contractual protection. We prepare bespoke clauses and/or advise on the effect of clauses prepared by others or industry standard clauses. We have also advised clients on disputes involving sanctions.
